Freedom of Information

The Freedom of Information Act 1982 applies to Energy Safe Victoria. The Director of Energy Safety is the principal officer authorised to make decisions on requests for access to documents.

A valid request must be:

  • In writing - not verbal;
  • Accompanied by an application fee of 2 fee units, which, since 1 July 2011, is $24.40 (unless waived or reduced because of hardship); and
  • Sufficiently clear to enable the agency to conduct a thorough and constructive search for the documents sought.

Release of Information: Policies and Procedures

ESV is established under the Energy Safe Victoria Act 2005 as the technical safety regulator of gas, electricity and pipelines in Victoria.


Members of the public often ask ESV provide information and documents. The Freedom of Information Act 1982 is a legal mechanism for obtaining access to documents in ESV’s possession. However, on occasions it is appropriate or mandatory for ESV to release documents outside of the freedom of information (FOI) framework. This document explains the circumstances in which ESV may disclose, or be required to disclose, documents in circumstances where a formal FOI request has not been made.


Where a FOI request is necessary, this document also sets out information on:

  • procedures and requirements for making a valid request;
  • documents that are exempt from disclosure under FOI;
  • access charges; and
  • review and appeal rights.
