Technical & Business Nominees

What are Nominees For?

Any person in the business of electrical contracting or offering to contract must be registered as an electrical contractor, in order to register as an Electrical Contractor, an applicant is required to have in place a Business Nominee/Supervisor and a Technical Nominee/Supervisor.  

Business Nominee/Supervisor 

As a Business Nominee/Supervisor, if the applicant will not be responsible for the business management and administration of the electrical contracting work, the person nominated to be the business nominee/supervisor assumes responsibility for the management and administration.

This requirement is to ensure the fair, ethical and compliance conduct of the registration. Therefore, ESV accepts Business Nominee/Supervisor nomination from an Accountant, who is a member of an accounting body.

ESV prefers completion of the Registered Electrical Contractors Course, which you will find available at most local colleges. As part of the application process, the consent forms are included to act as a Business Nominee/Supervisor.  

What do I need to do to be a Business Nominee/Supervisor? 

You are required to complete the relevant consent declaration for a Business Nominee:

  • Completion of the Registered Electrical Contractors Course, as available at local colleges.
  • As an accountant, you are appointed to act as a Business Nominee/Supervisor on behalf of the Electrical Contractor.

ESV may consider alternative business management qualifications, at which time, the qualification may be considered to be a deemed equivalent to the Registered Electrical Contractors Course.  

Technical Nominee/Supervisor 

As a Technical Nominee/Supervisor, you will be responsible for the effective supervision of the electrical installation work, carried out on behalf of the applicant, or holder of the Registered Electrical Contractors Registration.

Your employer, cannot force or demand you to act as Technical Nominee/Supervisor, ESV requires your consent to act in this capacity, by completion of a Consent Declaration and satisfying the criteria required in order to act as a nominee.

As a Technical Nominee/Supervisor you will ensure Certificates of Electrical Safety are completed, lodged and sent to ESV, this is particularly important when signing off the Certificate as the “responsible person”.  

What do I need to do to be a Technical Nominee/Supervisor? 

You are required to complete the relevant consent declaration for a Technical Nominee, or if you are unable to satisfy the requirements, you may complete your consent under Technical Experience. However, ESV reserve the right to refuse technical experience, and may require you to complete the Licensed Electrician’s Assessment.

Therefore, in order to be a Technical Nominee/Supervisor:

  • You will hold a Current Victorian Electrician’s Licence 
  • You will have completed the Licensed Electrician’s Assessment or Licensed Electrical Mechanics Assessment since May 1994 (via Epic Training Board or NMIT) 
  • You will have completed the Capstone Assessment in another state or jurisdiction, which ESV approves as an equivalent requirement 
  • OR your Consent as Technical Nominee/Supervisor is under Technical Experience, to which you are required to provide supporting documentation, which is detailed in relation to your experience, since 1999 to date. This may include supporting references, resume, any Certificate of Electrical Safety copies, which demonstrates your experience. This submission requires you to demonstrate that you are technically sound in order to waive the LEA/LEM or Capstone Assessment requirements.

I already hold a Contractors Registration and I want to change my Nominee, what do I need to do? 

You can request the change of nominee via Online Services as a Registered Electrical Contractor, by electronically scanning and attaching the required supporting evidence and Consent Declaration, or alternatively, are required to: 

Provide Written Letter (on letterhead, where possible) which details, which nominee is to be removed and your nominated replacement nominee.

All other evidence as per the relevant Consent Declaration, is applicable and must be provided.

Electrical Switchgear Workers as Technical Nominees/Supervisors 

We advise that Electrical Switchgear Workers Licences are currently not available, although regulated as of 27 April 2010, however, this licence type, when applicable, will also be able to be nominated as Technical Nominees/Supervisors. Further information will be updated to our website, when this licence become available.
