Supplying, selling and hiring
Find out about ESV requirements for the sale or hire of gas appliances.
Gas appliances for sale or hire, including second-hand appliances, must meet certain ESV requirements. Auction houses, dealers, and suppliers should ensure that all gas appliances have a 'data plate' affixed to them, and that those appliances are in a proper state of repair.
Supplying gas appliances for hire
Gas appliances for hire must have been accepted by Energy Safe Victoria and be in a state of proper repair.
When a gas appliance is offered for hire it is subject to Section 71 of the Gas Safety Act 1997. This requires the appliance to have been accepted by ESV.
Acceptance of equipment for hire
Domestic and light commercial type appliances (such as cookers, space heaters, central heaters, water heaters, catering equipment and leisure appliances – referred to as Type A appliances) are accepted when they have been certified by either the Australian Gas Association, SAI Global or ESV:
To show acceptance, the appliance must carry the Certificate number.
Compliance
Hire companies should be aware of these requirements and understand how to comply with them. Appliances offered for hire should be checked regularly to confirm that they can be operated according to the manufacturer’s instructions, that they operate properly and that safety items such a flame failure devices work.
Sale and supply of second-hand gas appliances
Second-hand gas appliances must have been previously certified and be in a state of proper repair.
The acceptance of a second-hand gas appliance may have been be negated by alteration or by relocation (this applies to appliances accepted under the AGA Tier 2 arrangement, as denoted on the appliance badge). If acceptance has been negated, reacceptance must be obtained before commissioning. It is an offence to supply or sell an appliance that is not accepted, including a second-hand appliance.
It is common for a second-hand gas appliance (and occasionally new appliances) to be offered for sale by auction. Sale (and supply) of any Type A gas appliance is subject to Section 71 of the Gas Safety Act 1997. This requires the appliance to be accepted by ESV for the purposes of sale or supply.
Acceptance for domestic and light commercial type appliances (such as cookers, space heaters, central heaters, water heaters, catering equipment and leisure appliances; referred to as Type A appliances) is through certification by the Australian Gas Association (AGA), SAI Global or alternatively by direct acceptance by ESV on application, using Schedule 4 of the Gas Safety (Gas Installation) Regulations 1999. To show acceptance, the appliance must carry an AGA, SAI Global or ESV badge.
Checking if accepted
Every gas appliance is required to have a 'data plate' affixed to it, showing essential details (type of gas, energy consumption, etc). That data plate should show the Certificate Number). If found, that number is evidence of acceptance.
The badge, and in a few cases the data plate, may have been removed. If the make, model and serial number can be positively identified and if a certifier confirms that this make and model is that of a certified appliance, the appliance may be regarded as accepted.
Applying for acceptance
ESV will receive applications from licensed gasfitters for acceptance of second-hand gas appliances
On receiving an application, ESV assesses the appliance against an appropriate standard (this may differ to the standard applied when the appliance was manufactured). If the gasfitter provides sufficient verification that the appliance complies with that appropriate standard, ESV will accept the appliance and will supply an acceptance badge.
If information supplied is insufficient or the required safety devices do not comply, ESV will not accept the appliance.
