Exemptions

Energy Safe Victoria accepts the following exemption applications:

  1. Exemption from Regulation 401 of the Electricity Safety (Installations) Regulations 2009 – exempting any electrical work or any person from the requirements of the Electricity Safety (Installations) Regulations 2009 or the relevant Standards, and
  2. Exemption to install electric lines on public land – under section 47 of the Electricity Safety Act 1998 (the Act) for persons other than those specified in the Order in Council.

Provided below is information about each exemption type, including how to lodge an exemption application and links to application forms and guidelines.

Regulation 401 exemption

ESV may exempt any electrical work or any person from the requirements of the Electricity Safety (Installations) Regulations 2009 or the relevant Standards referenced as normative, subject to any conditions specified by ESV (regulation 401).

Exemptions under regulation 401 are NOT used for applications for exemption under section 47 of the Electricity Safety Act 1998 in relation to electric lines installed on public land. Refer below.

Regulation 401 exemption applications

Exemption applications must be in writing and include the following information:

  • Applicant’s name, telephone number, business and postal address
  • Exemption requested
  • Reasons for the exemption
  • Relevant technical information, including details showing that the granting of an exemption will not reduce the level of safety from physical injury, fire and electric shock from the level that would be provided under the Electricity Safety (Installations) Regulations 2009 or the relevant Standards
  • A written agreement to the proposed exemption signed by the owner, occupier or controlling body of the land on which the work is to be carried out

Application fee

The application fee for a regulation 401 exemption is $80.00.

This is equivalent to 5.99 fee units. (The Victorian Government adjusts fee units annually)

Application fees are non-refundable.

Payment of the application fee does not infer that an exemption will be granted.

Compliance with an exemption

A person to whom an exemption applies must comply with any and all conditions of the exemption imposed by ESV.

ESV may revoke an exemption.

Substantial penalties apply to persons who do not comply with the requirements of the Act or the exemption.

Installation of electric lines on public land exemption

Section 46 of the Electricity Safety Act 1998 specifies those persons permitted to install electric lines on public land.

Currently there is an exemption in place to permit others to install electric lines on public land provided certain requirements are met. These requirements are specified in an Order in Council (see below).

Guidelines and Order in Council

  • ESV has produced guidelines about the exemption process and the legislative requirements of the Order in Council. The Electric lines on public land exemption guidelines aims to assist those persons not specifically permitted in the Act and who wish to install electric lines on public land.

Exemption applications for electric lines on public land

ESV requires that exemption applications for electric lines on public land include the Electric Line on Public Land Exemption Notification Form (see below) and:

  • A copy of the consent of the distribution company whose supply network the electric line will be connected to, and
  • Details of the electrical line to be installed, including but not limited to the operating voltage, cable size, number of cables, intended cable route and map co-ordinates sufficient enough to identify the intended location of the cable.
