Notice of preparation of Regulatory Impact Statement

Electricity Safety (Registration and Licensing) Regulations 2020

Notice is given under section 11 of the Subordinate Legislation Act 1994 that a Regulatory Impact Statement (RIS) has been prepared in relation to the Electricity Safety (Registration and Licensing) Regulations 2020 (the proposed Regulations).

The proposed Regulations, to be made under the Electricity Safety Act 1998 (the Act), are intended to replace the Electricity Safety (Registration and Licensing) Regulations 2010, which sunset on 31 December 2020.

The proposed Regulations will also prescribe, for the first time, some types of electrical linework as being work that may only be carried out by licensed electrical lineworkers.

The proposed Regulations will also enable ESV to require licensed electrical workers to complete skills maintenance and skills development activities before being able to renew their electrical worker’s licence. These requirements are commonly referred to as continuing professional development or CPD requirements.

The RIS examines the impact of the proposed Regulations and possible alternatives, and concludes that the proposed Regulations are the best means of meeting the objectives of the Act and the proposed Regulations.

Lineworker registration

Subject to confirming their registration details, lineworkers registered with Energy Safe Victoria will, from 1 January 2021, be automatically licensed to carry out the linework they hold a registration for. Lineworkers who are automatically licensed will receive their first licence free of charge after 1 January 2021.

Skills development and maintenance

If the proposed Regulations are made without any changes there will be a staged introduction of Skills Maintenance and Skills Development requirements. Skills Maintenance and Skills Development requirements will not apply to any licence renewals until 2023 at the earliest.
